If you are a member of the Class Action and do not want to participate in the case, you can choose to opt out. You must opt out by November 11, 2026.

What happens if I opt out?

You do not need to opt out if you want to remain part of the class action. If you opt out:

  • You will not receive any money that may be recovered in this Class Action.
  • You will not participate in the Class Action.
  • Your spouse, relatives, or anyone who could make a claim because of their relationship to you will also be excluded from the Class Action.
  • You keep the right to bring your own claim.

Complete the secure online form. Your responses will be submitted electronically. 

Option 2: Print and mail the form

Download and complete the paper form, then mail it to Plaintiffs’ counsel: New Mexico Center on Law and Poverty, 301 Edith Blvd. NE, Albuquerque, NM 87102.
